The Right to Recognition

Individuals have the right of recognition everywhere as a person including, but not limited to, before the law.

[Refer to UDHR Article 6] “Everyone has the right to recognition everywhere as a person before the law."

Legal institutions and systems should take into account the technological potential for fabricating evidence and implement measures to verify the authenticity of materials deemed admissible as evidence in court.
This right seeks to ensure that identity is guaranteed on an individual basis among humans, as well as to differentiate human identity from non-human identity. This encompasses an individual’s right to identify themselves and authenticate their identity in any context or environment.

This right extends to being able to recognize and authenticate the identities of other individuals as well.

While Article 6 of the original UDHR states that “Everyone has the right to recognition everywhere as a person before the law,” the digital age has introduced a host of new meanings to what it means to be recognized as a person - both before the law and elsewhere. For this reason, the new right proposed that this recognition of personhood includes the law but also extends beyond it.

Everyone has the right to protection of the law from material productions and the sharing of these productions of which they are the physical and/or intellectual basis.property

[Refer to UDHR Article 27.2] “Everyone has the right to protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author.”

[Refer to UDHR Article 12] “No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks.”

This entails the right to be protected from attacks upon honor and reputation. Protection of the law against such attacks is guaranteed in instances of sexual exploitation and may be extended to any other case depending on the circumstances.
The physical basis and/or intellectual basis refers to any and all identifying characteristics of an individual.

The various mediums discussed in the original UDHR could not possibly anticipate how artificial intelligence would completely revolutionize what constitutes an individual’s production. Similarly, attacks on “honour and reputation” did not conceive of the ability to produce malicious media in such hyper-realistic ways that people could be easily manipulated into believing that something is genuine when it is actually not. To account for these present-day issues, this right unifies Article 27.2 and Article 12 of the original UDHR.

Article 27.2: “Everyone has the right to protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author.”

Article 12: “No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks.”

Which Face is Real?

Why do we need these rights? Well…

A finance worker in Hong Kong was scammed into transferring about $25.6 million USD to fraudsters in February of 2024, after successfully being deceived from a video call deepfake with who he thought was the chief financial officer at his company instructing him to do so.
India is grappling with a wave of romance scams, with 66% of people in the country reporting to have been victims in an online dating scam and an overwhelming majority, especially among more vulnerable populations like the elderly, saying they lost money in such scams.
The MIT Technology Review published an article in 2021, detailing how malicious applications of deepfake technology have real-life consequences – especially when it comes to image-based sexual violence. Ordinary people and celebrities alike are being digitally exploited in synthetic media that steals their identity for pornographic purposes.

The Right to be Forgotten

Everyone has the right to ask for personal dataproperty to be removed from the internet if they think it is no longer necessary. This means that people can ask websites, search engines, and other digital platforms and directories to delete their data, so that their privacy can be protected.

The right to delete personal information applies only to individuals and does not apply to corporations or organizations.

This right to have personal information deleted does not override other important rights. This includes, but is not limited to, the freedom to expression and the public's right to know.access Information important for the public interest or historical record must be protected.

Requests to delete personal information must be handled quickly and fairly by those who hold the data. Individuals should have a clear and simple way to make these requests, and organizations in charge must explain their decision to the individual.

If personal information is spread without consentproperty and causes harm, individuals have the right to seek help and get that information removed, especially if it affects their dignity, security, and privacy in society.

The Right to Deconstruction

Everyone has the right to non-participationagency in digital profiling by their personal dataproperty, data associations, and algorithmic groupingaccess.

Article 20.2 of the UDHR states: "No one may be compelled to belong to an association." In the context of a person's data, an association refers to a categorization determined by surveillance on a person's data or data created by other people that can be linked to that individual. The ability to not participate and reject a given profile is important to the protection and detachment of a person's identity from an unreliable categorization.

Everyone have the right to reject any algorithmic grouping and digital profilingaccess.

No one should be discriminated against or criminalized on the basis of any categorical identification including algorithmic groupingaccess.

*Surveillance uses data to sort people categorically.

Recognizing exclusionary practices of people and institutions of power who can weaponize the digital space, there needs to be protections for people to reject categorical identifiers assigned to them by these systems of surveillance.

AI and predictive technology is becoming more accessible to the public. This also means it places higher risk of surveillance and continues systems of harm for individuals, especially for margenalized populations. Here are some cases of categorical harm:

An example of algorithmic racial bias extending to the healthcare sector, where predictive technology is being used more often to decide patient health risk and treatment: A study on a clinical algorithm in use in actual hospitals showed that the algorithm assigned the same health risk-level for black patients who were much sicker than white patients at the same supposed risk.
In the U.S. justice system, the use of algorithms to predict recidivism - the probability of an incarcerated person re-offending - is becoming more prevalent. A study on one of these tools COMPAS reflected a racial bias in which black people were twice as likely as white people to be labeled as high-risk but not actually re-offend.
Gang databases around the U.S. are used by police and other law enforcement agencies as justification for surveillance and arrests. Many of these are notoriously inaccurate, falsely linking people to gangs. One database in California included 42 babies as gang members.
